This Warranty Agreement ("Agreement") is made effective as of March 25, 2026, by and between Vagabond Racks LLC, with a principal place of business at 112 4th Avenue, Bradley Beach, New Jersey 07720 ("Manufacturer"), and the original consumer purchaser of the Covered Product ("Customer").
Covered Product: This warranty applies to all storage, organization, and display products and related hardware manufactured and sold by Vagabond Racks LLC (the “Covered Product”), including but not limited to wall-mounted racks for sporting equipment, shelving, and similar lifestyle products. Coverage is based on proof of purchase.
Limitation of Damages. In no event shall Vagabond Racks LLC be liable for consequential damages for breach of this warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to the buyer.
Warranty Coverage. Vagabond Racks LLC warrants the Covered Product to be free of all defects in material and workmanship for 1 year from original date of purchase. This warranty is non-transferable and applies only to the original consumer purchaser.
Scope of Warranty. This warranty covers:
This warranty covers defects in materials and workmanship under normal residential use and conditions, provided the product is properly installed in accordance with Vagabond Racks’ instructions and intended use.
For purposes of this warranty, 'normal use' means use of the product for its intended purpose of indoor storage, organization, and display of household goods, sporting equipment, and decorative items, when properly mounted to appropriate structural support (such as a wall stud) and used within recommended weight limits.
This warranty does not cover any issues arising from improper installation, failure to follow instructions, overloading, misuse, or use outside of the product’s intended purpose.
This warranty does not cover:
-
Damage due to misuse, abuse, accident, or neglect
-
Unauthorized modifications or repairs
-
Normal wear and tear
Customer Obligations. To obtain warranty service, the Customer must notify the Manufacturer of the defect within the warranty period, provide proof of purchase, and return the Covered Product for inspection if required.
Remedies. If a covered defect is found, the Manufacturer will, at its sole discretion:
-
Repair the Product using new or refurbished parts;
-
Replace the Product with an equivalent model; or
-
Refund the purchase price
Limitation of Liability. To the maximum extent permitted by applicable law, Vagabond Racks LLC shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of revenue, loss of use, or damage to third-party property, arising out of or related to the use of the Covered Product.
Exclusions. This warranty is void if the Covered Product has been:
-
Altered or repaired by an unauthorized person;
-
Used for purposes other than its intended use;
-
Damaged due to environmental conditions not recommended by the Manufacturer
Installation & Third-Party Property: This warranty is strictly conditioned upon the product being installed directly into wooden wall studs using the provided Vagabond Racks hardware. This warranty is void if the product is installed into drywall alone, or if non-Vagabond hardware is used. Vagabond Racks LLC is not responsible for, and this warranty does not cover, any damage to walls, ceilings, floor surfaces, or third-party property—including but not limited to surfboards, snowboards, or skis—resulting from the use or failure of the product.
Governing Law. This Agreement shall be governed by the laws of New Jersey.
Entire Agreement. This Agreement contains the entire agreement of the parties with respect to the subject matter contained herein. No other promises, warranties, representations, agreements, or understandings, whether oral or written, exist concerning this subject matter. This Agreement supersedes any previous or simultaneous oral or written promises, warranties, representations, agreements, or conditions between the parties.
Severability. If any provision of this Agreement shall be held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid, illegal, or unenforceable, but that by limiting such provision, it will become valid, legal, and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Alternative Dispute Resolution. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations among the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution ("ADR") procedure.
If any controversies, claims, or disputes arising out of or relating to this Agreement cannot be resolved through negotiation, the parties agree to try in good faith to settle the dispute by mediation in accordance with any statutory rules of mediation. If mediation is unavailable or unsuccessful in resolving the entire dispute, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The parties shall select a mutually acceptable arbitrator knowledgeable about issues relating to the subject matter of this Agreement. The arbitrator's award will be final, and any court with proper jurisdiction may enter judgment upon it. During the continuance of any arbitration proceeding, the parties shall continue to perform their respective obligations under this Agreement.
